Umark Inc. (“Umark” or “we”) recognizes the importance of an individual’s right to protect personally identifiable information and this privacy policy ("Policy") sets out the privacy policies and practices for Umark with respect to how Umark may collect personal information. It also describes how Umark collects, maintains, uses, manages and discloses personal information.

This Policy applies to information collected by Umark through the website and/or any of its subdomains (collectively, the "Site"), as well as other places where we may collect personal information. This Policy also sets out how you can access certain information that Umark may collect about you. In this Policy, "personal information" means information or opinion about an individual whose identity is apparent or can be reasonably ascertained from the information or opinion as further defined under applicable privacy laws.

By using the Site, using the Umark search engine and/or ordering trademark filing or other services from Umark, you agree to the terms and conditions of Umark’s Policy and accept the practices described in this Policy. Umark reserves the right, in its discretion, to change, modify, add or remove portions of this Policy at any time and from time to time, without prior notice to you. If our Policy changes in the future, we will notify you of any such changes by posting an updated policy on our website. Following the posting of such changes, your continued use of the Site will constitute your acceptance of these changes and you will be bound by such changes. If you do not continue to use the Site following a change to our Policy but take no other action with respect to your personal information, our use of that information will remain subject to our Policy as it was in effect prior to the change. Please understand that this Policy does not apply to such third party websites, and Umark is not responsible for the content of such third party websites or the privacy practices of such third parties. Therefore Umark encourages you to request and review the privacy policies of any third parties upon disclosing your personal information to such parties or when visiting such third party websites.

Financial Information

We do not currently collect financial information, such as your payment method (valid credit card number, type, expiration date or other financial information). That information is collected and stored by our third party payment processing company, and use and storage of that information is governed by that company’s terms of service and privacy policy. BY SUBMITTING PERSONAL INFORMATION TO UMARK OR ITS SERVICE PROVIDERS AND AGENTS, YOU AGREE THAT UMARK AND/OR ITS SERVICE PROVIDERS MAY COLLECT YOUR PERSONAL INFORMATION AND YOU CONSENT TO THE USE, DISCLOSURE AND TRANSFER OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY AND AS PERMITTED OR REQUIRED BY LAW. Subject to legal and contractual requirements, you may refuse or withdraw your consent at any time by contacting Umark at the address provided on the contact us page. If you refuse or withdraw your consent, you acknowledge that Umark may refuse or be unable to provide you with services or information offered on the Site. Collection of Your Information

We may collect personal information from you when you save or otherwise provide your personal information to us, such as by searching, filling out an application, placing an order, logging in as a registered user (if applicable), or providing information to your account, communicating with us by phone, e-mail, or otherwise or if you complete an entry form to participate, for example, in a contest, promotion, sweepstake or survey.

Umark’s website is directed for use by adults. Umark does not knowingly collect any personal information from children under the age of 16. Those under age 16 should not use Umark's website or provide us with any personal information.

Umark may use your personal information to: (1) process your order and to answer questions about the status of your order; (2) send you details on services you ordered; (3) maintain contact with you and provide you with ongoing personalized service; (4) communicate with you (via e-mail, post or otherwise) and provide you with promotional materials and additional information regarding our services, surveys, contests, promotions and special offers; (5) help us learn more about your ordering preferences; (6) conduct or administer contests and promotions; (7) enforce any policy or agreement on the Site and protect Umark against negligence, breach of contract, fraud or other illegal activity; and (8) conduct marketing and performance research, to assist us in measuring our customer service, benchmarking our performance and to help us improve the experiences and our service offerings. The personal information that Umark may collect may include your name, username, password, email address, age, date of birth, gender, address, telephone numbers, credit card and debit card numbers (with expiration dates), personal preferences, company information (including addresses, emails and telephone numbers), brands, trademarks, logos, designs, product/service interest information and any other personal information that you choose to submit or include in your profile, or in other communications to Umark. You represent and warrant that you have the right and authority or have obtained all necessary consents to provide any information, including any personal information of another individual, which is provided by you to Umark. We may also maintain a record of your service interests and acquire information about you from our present and future affiliates or divisions.

Umark may also collect information that may not be personal information, which may include, but is not limited to, the frequency of user visits to the Site, the routes by which users access the Site and use of any hyperlinks that may be made available on the Site. Umark or its service providers and agents may process and use this aggregate data for various purposes including, but not limited to, analysis of this data for trends and statistics, development of the Site and the Site’ features and offerings, assessing patterns of use, or planning and evaluating marketing initiatives. This information is gathered by certain tools and methods such as the collection of your IP address and/or the use of cookies and is maintained, used and disclosed in aggregate form unless otherwise noted.


Like many websites, Umark may use “cookies” to maintain a record of your visits to the Site. This information does not identify you personally and you remain anonymous unless you have otherwise provided Umark with personal information that will allow us to identify you.

Disclosure of Your Information

Umark may disclose your personal information to its trademark lawyers, trademark agents, subsidiaries or affiliates and to third parties whom Umark contracts to provide services on Umark’s behalf, including, but not limited to, support services and website services. Umark may also disclose in order to deliver promotional materials, contests, sweepstakes and other promotions, and answer customer questions about Umark’s products and services. These subsidiaries, affiliates and third parties may be located in Canada, the US or overseas. Umark will only provide those third parties with the personal information that they need to deliver the services to Umark and/or on Umark’s behalf. Umark respects your privacy and will only use your personal information as explained above. Umark will not otherwise sell your personal information to third parties for marketing purposes.

Retention of Your Personal information

The personal information that you provide will be retained by Umark in accordance with applicable laws. However, Umark may in the course of its business destroy information it deems to be stale or obsolete and will take reasonable steps to destroy or permanently de-identify personal information it holds if it is no longer needed for Umark business purposes.

Choice and Opt-Out Preferences

Umark does not collect your personal information unless you choose to provide it. If, at any time, you prefer not to receive further email communications from Umark (except in connection with information, products or services that you specifically request), you will have the ability to unsubscribe from such communications by means of a link provided in every broadcast e-mail that is sent to you by Umark. However, if the email communication is required in order to properly process an order, your request to cease communication will relieve Umark and its agents of any liability for failure to further process any order.

Access and Correction

Umark will take reasonable steps to ensure the personal information it holds is accurate, complete and up to date. Upon your written request and provided your identity can be verified, subject to certain exceptions, Umark will inform you of storage and disclosure of your personal information and give you access to that information. Additionally, if you have any questions or enquiries relating to our privacy practices or procedures, or if you believe that the personal information that Umark holds about you is not accurate, complete or up to date you may write to us at the address provided below. If you are able to establish that the information is not accurate, complete or up to date, we will take reasonable steps to correct the information.

Use of Google Analytics

Umark may use Google Analytics, a website analysis tool provided by Google. Using cookies, Google Analytics collects information about your browsing, the pages you visit, the date and time of your visits and the links you click. It also records the type of operating system your computer uses, the language of your browser, the name of your Internet service provider and your geographic location. The data collected and your anonymized IP address (truncated address) are kept by Google on servers located, in particular, in the United States. Google uses this information only to produce statistics and reports on browsing within the Information feed section. Google may communicate the collected data to third parties when legally required to do so or when third parties process the data on its behalf.
